Business Bankruptcy Chapter 7

When a business cannot service its debt or pay its creditors, the company or its creditors can file with a federal bankruptcy court for protection under either Chapter 7 or Chapter 11.

Both individuals and businesses are eligible to file for Chapter 7 bankruptcy protection. A business Chapter 7 will liquidate the company's assets to pay off its creditors.

Chapter 7 VS Chapter 13 Bankruptcy

Filing for chapter 7 bankruptcy means that you are asking the court to discharge your debts, without owing anything to most if not all of your creditors, while chapter 13 bankruptcy involves a plan to pay off your debts over a decided period of time. There are pros and cons to both, which Attorney Moulton will explain to you. If handled correctly, filing for bankruptcy can help reestablish credit, stop garnishments and halt other debt collections.

Protect Your Assets

If you decide to file for bankruptcy, you will have to provide a list of all of your assets with their market value. If you fail to disclose an asset, the court can deny your discharge. Once filed, an “automatic stay” will take place, which prohibits creditors from continuing collection action pending further actions of the bankruptcy court. A trustee will be appointed to administer the case.
